A Guide to the Privacy and Electronic Communications Regulations 2003 (PECR)

The Privacy and Electronic Communications Regulations 2003 (known as the PECR) prohibit businesses and other organisations from sending marketing communications by e-mail, text message, phone, fax or any other electronic method without the recipient's consent.

They also regulate the use of website cookies and similar internet technologies.

The PECR has been amended several times, most recently in January 2019 when they were updated to cover changes made by the General Data Protection Regulation (GDPR).

It outlines how the PECR applies to each type of electronic marketing communication; e-mail, text message, phone and fax. It explains PECR provisions relating to the use of cookies and the penalties for failing to comply with the PECR.
