A Guide to Employing Staff on Fixed-term Contracts

It is sometimes necessary for employers to recruit additional employees for a fixed period of time, for example in order to meet increased seasonal demand or to provide cover for employees on maternity leave.

People employed on fixed-term contracts are covered by the Fixed-term Employees (Prevention of Less Favourable Treatment) Regulations 2002 and the Fixed-term Employees (Prevention of Less Favourable Treatment) Regulations (Northern Ireland) 2002, which give them the right to be treated no less favourably than comparable permanent employees.

This factsheet looks at employing people on fixed-term contracts. It explains what a fixed-term contract is and the situations in which they might be used. It also gives an overview of the Regulations and some pitfalls to be aware of.

Employment law is a complicated area and this factsheet is intended as a starting point only. Professional advice should be sought before any decisions are made.
